Great info on the proceedings with Ellison. It's maddening that she will likely get off easy when she as complicit as SBF. I would not be surprised if she gets probation, plus a fine. I wonder if there is any way to recover some of the donated funds given that the source of those funds was illegal.
I agree with you. She seemingly knowingly misused customer funds and directly benefited from it.
For the donations: the answer would be kind-of. Unspent money could be recovered. However, if the politicians spent the money in 'good faith' and without knowing the money was stolen, recovery will be extremely difficult (I think it will turn on whether they should have done any additional checks). After all, if it can be clawed back from the politicians, can it then be clawed back from the people they paid to print their t-shirts as well (and so on)?
I should check the precise US law on that though. I'm a bit more familiar with the laws of remedies and restitution (as opposed to the US statute law).
I think the Bankman Fried family will be dogged to the ends of the earth for every last asset they have. They have entered a never ending legal nightmare. I don’t think it will be the same for Caroline’s family. I think liability stops with her.
That makes sense that recipients of donations would not be liable to repay unless they did something wrong. However if donor funds were sitting somewhere, (which is unlikely) it would seem unfair to recall funds in those cases but not the others. Anyway this case is fascinating. I look forward to more info.
